Eachnet Wins Copyright Infringement Case

The domestic media are reporting how Mr. Jing Yutang and Jiangsu Tanghuang Home Textile Company found some bedding products, bearing a strong resemblance to their own patented products, posted on the website of Eachnet.
They subsequently sued both Shanghai Eachnet Network Information Service (Shanghai) Company and Shanghai Eachnet Trade Company for infringing upon their rights and asked the latter for CNY200,000 in compensation. On September 13, the Shanghai No. 1 Secondary People's Court heard the case.
However, as the court maintained that the network transaction service is neither the subject nor the direct implementer of the transaction, and that the accusers could not provide relevant evidence showing that they had bought the concerned goods from the defendants, the court turned down their litigation request.
